Please help me with the following issue!

I came from India on an F1 in August 2002.
My F1 Visa on my passport expires on December 2004
I got my OPT on August 2004 valid through August 2005
I recently got my H1 and my H1 started on October 2004. Now I am working on any H1.

My question is since my F1 VISA on my passport expires on December 2004 do I need to go to India right away to get my new visa. Or can I stay in this country for some more time and go to India some time next year to get my new visa. I hope my stay in USA with an expired visa does not make me illegal
Please help!

The visa expiry on your passport doesnot make you illegal. As long as you have approved H-1 and working you are fine. You need new visa if you are planning to travel outside US. You can get your visa stamped in US consulate in your home country or Canada or Mexico. If you are not planning to travel you are just fine.

Make sure your H1 approval notice have I 94 at bottom. Otherwise you are not legal to stay in US.

Isn't H-1B a visa? I mean, I hear people say like, "I got an H-1B visa (while staying in the U.S.) so now I can travel," something like that?

Xalidag,
U are missing the basics. H-1B visa approval has two parts. 1) Change of status 2) Actual visa stamp on passport.

So when someone says "I got an H-1B visa (while staying in the U.S.) so now I can travel," it means he's got an change of status approved, which makes him legal to stay in the US but cannot reenter US with it. He needs to get the H1 stamped on passport based on it.
