Help - EAD Question !!!!

Hi Everybody,

Can some help me.....

The following are my details

- H1 with previous company valid until 02/08/04
- Visa Stamp valid until 02/08/04
- Joined new company got new H1 valid until 06/24/04
- Went to India in March 2002 and return to US April 2003, I-94 issued at port of Entry is valid until 02/08/04
- Applied I-140 and I-485 in April 2003
- Applied EAD and AP in Nov 2003

Q1) If my EAD is NOT approved by 02/08/04, do I need to stop working until I receive the EAD

Q2) What are the alternatives, apply H1 extension or Interim EAD (I will be completing 90 days of applying EAD on 02/04/04)

Q3) If we apply Interim EAD at local BCIS will GC process take long time.

Please suggest. Greatly appreciate your response

------- Is this H1 Transfer?
- Went to India in March 2002 and return to US April 2003; I-94 issued at port of Entry is valid until 02/08/04
------ if you transferred H1 then you might have got I-94 attached with approval notice lower right side and it should be valid till your H1 transfer until 06/24/04


- Applied I-140 and I-485 in April 2003
- Applied EAD and AP in Nov 2003

Q1) If my EAD is NOT approved by 02/08/04, do I need to stop working until I receive the EAD
------- you need EAD approved for work in hand or valid H1 status for work. You can also file for H1 extension before your I-94 expires and can continue on H1.it will be in your interest not to use EAD till I-140 gets approved because if due to any reason I-140 is denied then EAD, AP, I-485 all will be denied and you will have no status, better file h1 extension and maintain H1 status (you are also qualified for 7th year H1 extension)
Q2) What are the alternatives, apply H1 extension or Interim EAD (I will be completing 90 days of applying EAD on 02/04/04)
------ I will file H1 extension and also will go for iEAD after 90 days of EAD filing to local USCIS office or wait for EAD from service center one can have EAD and H1 at the same time. If you use EAD you will NOT be on H1 status
Q3) If we apply Interim EAD at local BCIS will GC process take long time.
------ no, it has nothing to do with I-485
