Help - EAD pending recieved "Non-Delivery of Other Notice "

Dear gurus,
I need your sincere advice and help. Here is my detail

EAD RD – 01/13/09
Current Status – Pending
EAD expiring – 04/12/09
Filed – Paper based
I485 – Still pending, out of processing date.

Wife's EAD was approved on Feb 2nd. I applied both of them at the same time.


Chances are that I will loose job if I do not get EAD timely so I called NSC around 60 days to check status and opened SR on 03/12. I received reply in mail with the following details

Dear :

On 03/12/2009 you, or the designated representative shown below, contacted us about your case. Some of the key information given to us at that time was the following:

Caller indicated they are:
-- Applicant or Petitioner

I am very nervous. Please suggest what could this mean and what should I do?

I am very nervous. Please suggest what could this mean and what should I do?

You must take infopass with local USCIS and then local USCIS will contact the service center where EAD extension is pending.If possible talk to supervisor of Local USCIS. Go with employer letter that if you don’t have valid EAD on date… you will not have job. If no letter then let them know that if EAD is not approved before date… you will lose job.(take the EAD filing receipt with you.

I have taken appointment on 03/26, which is 72nd day after my filing. Will they let me in. Any suggestion how best I should plan to get in which is way before the 90th day benchmark.

They will let you in, but they will not discuss or at least will not take any action or do anything before passing 90 days. It is very clear as one of the reasons why you want InfoPass (90 days or more pending application) many people try to get around that by simply pick that options even before 90 days, others select other options and so on. You have to have the appointment past 90 days. This is simply because most of the cases will have a decision by then. Being applied 89 days before expiration of the current EAD (not 120 days in advance as USCIS recommended) is the applicant's fault, not the USCIS. Your wife approval some time ago is not an argument to support your case, every case is different even if applied in the same day. The range between cases approval is very wide and I do not think there is any logic behind that, we just deal with facts.

You've got nothing to lose. Getting in shouldnt be a problem and as suggested, go talk to them and pitch in your case. These are unprecedented times and with your job being dependent on EAD that should be a good enough reason to request some expediency. You might have to be a little persistent - but not irritating - to get the seriousness of the situation through to them. If they oblige, good else fix up another appointment 18 days later. Good luck!
