HELP:: AOS for DV2006

Dear all,

MY CURRENT
I am a F-1 full time student. I have valid I-20 until 2007. I won DV-2006 with EU 17XX. I got my interview date at local office on Oct. 17th, 2005.

MY PAST
In Fall of 2004, i had dropped a class and went out of status. I immediately realised my mistake and re-instated in 2 months.

MY FUTURE??
1. am i eligible for AOS?
2. i do not come under any 3year or 10year BAR, is that a valid arguement to make to the Adjustment Officer (AO)?
3. is there anything else that one can think of in this situation?

I would appreciate your help greatly. PLEASE PLEASE, any input that you can have.

Hi Naser,

sorry, I can't provide you with any input regarding your question. I am just wondering when you sent your I-485. The Oct-17-06 interview date looks to me unrealistic.

Yes, since you are now in legal status

2. i do not come under any 3year or 10year BAR, is that a valid arguement to make to the Adjustment Officer (AO)?

the BAR applies only to those who have accumulated illegal presense (not "out of status" time) of over 180 days and LEFT the US. You didn't leave the US and you never accumulated any illegal presence.

3. is there anything else that one can think of in this situation?

Have ALL immigration documents ever issued to you with you and their copies at the interview. Be confident, but not rude.

but in i485 instructions it says that you are not aligible in case you failed to maintain your status continiously.i was out of status for a month or two.

Can you give us a little bit more info about your AOS interview date? When did you send your case to CIS? Which office did you send your case?

CIS regulations also state "who previously has been out of status" ineligible
I have similar (or worse) problems - 4 months out of status and 2 months illegal presense (alas, due to attorney mistake!) - and still my lawer told me I am eligible for AOS - though I dont understand how but have no other choice.
