Have I140 approved do we have to wait for visa number ?

Husband has H1B and approved I140 last year, attorney at the company he works for says we has to wait for the visa number to become available in order to move to the next step. I485...I have a H4 and have been unable to work for years. I've heard that once we get the I485 filed I can get a EAD??

Can you advise what the right thing is to do in order for me to work?

Yes

You have to wait untill your PD is current.Option is you can file H1 AND START WORK

---------that is correct he can file I-485 when PD becomes current

----------with your spouse I-485 you will also file derivative I-485 AND I-765 and can get EAD. once get EAD you need to go to SSA office to apply for SSN and then you can work

--wait for the PD and file H4 extensions with spouse H1 extensions. I dont see other option you could have changed H4 to H1 status(if qualified and employer was ready) but now H1 numbers are over.

Husbands I140 was approved in 2005 and the company he works for has not yet filled out the I485. Reading through the forums messages, am I correct to say you can apply for the I485 before your PD has become current?
Have it pending until your PD is current??

No, you can't file 485 at that time. Read messages again.
