Have H1B,Can I work on the Side?

I have a H1-B visa. Can I work on the side by working on Computer related projects to make extra money. Like work on projects from eworks.com.

They(eworks.com) are asking to fill up form w-9 and 1099, is it OK to do so?

Please let me know guys.
 
You are not allowed to work and get paid other than the sponser.
Getting W9 and 1099 will put you out of H1 status and invite denial for your GC in the future.

You can open you own company, but you are not suppose to work for that company but you can employ somebody and paythem thro your company. Otherwise you have to get h1 for your self through your company but that is nowadays not feasible.

great guru, are you saying that a 1099 in your tax transcript will put you in trouble in future and invite denial for GC? I mean it will only happen since CIS will see 1099 in his tax docs and then conclude that he was engaged in unauthorized work and reject his application? Do you know if they ask for explanation when they see 1099? I think there are people out there paid with 1099-misc instead of W-2 and not everybody is a tax expert here so that they can teach their employer what to do. If yes, what about 245(k), which I believe says that it is ok if you did this mistake for less than 180 days and did not repeat it since last entry etc.?

PS: No matter what any non-resident alien should avoid any activity which will jeopardize their status in this country.
