Have GC but want to get married and bring my spouse from India

Hi,

I already got GC but want to get married and bring my spouse from India. Is there any process for this. As, I heard that I have to file for 1-130 and then apply for it and get her here after she gets the approval. Is there no way that I can get my spouse on a dependent visa like H4 or K visa?

Because of this I am still stuck. Any help would be appreciated. Thanks
 
Well, as you said you are kind of or would be stuck as it is.

If you get married, you can apply for your spouse but the waiting is 5 years or so. And your spouse probably will be denied the entry to the US during this time since already showed "immigrant intent".

Only H4 can be granted if the main sponsor is H1 which you are not since you are a permanent resident. I think you are thinking on K1 visa is only for US citizens. Your future spouse can try to get an H1B by him/herself.

For how long you have been a permanent resident? You can apply for citizenship after 5 years and other conditions may apply and after get the citizenship, then you can get married and there is no waiting period (only like 3-8months) for your spouse.

One thing you can do is....
if all agree, bring her here on tourist visa/visitor visa and mary in USA....
ofcourse you will miss all those treditional weddings with 1000+ relatives...
then apply for adjustment...hope this will work out.. :D :cool: :)
 
He is a permanent resident not a US citizen, so the future spouse will be out of status once the I-94 expires. Remember, s/he is a permanent resident not a US citizen, so the spouse must wait for a visa number and priority date only people who marry US citizens can apply for adjustments of status right away since there are no waiting period.

This advice is foolish and illegal --- foolish, because he is not a USC - only a permanent resident and her stay in the US will be unauthorized. However, even if he were a USC, the advice is still ILLEGAL --- she is not supposed to come to the US on a tourist visa with the intent to marry as soon as she arrives and stay permanently.

This issue has come up several times on this NG. I wish individuals who keep advocating this will take a hint and stop advocating unlawful action. Or at least not be so utterly idiotic as to post their nonsense here.
 
When did this start? I have 2 aunts who got married to permanent residents in the early 80's and they got their greencards in about 2-3 years after they applied. One of my aunt's even added her 3 kids and they too got theirs. :confused:

FB2A has been backlogged for years now. It was like this back when I first started looking around in 1997. It's not the early 1980s anymore. :)

Wow! Just within 24 hours I had so many good inputs. Thank you guys. I lost this website address after I got my GC. It has been almost 2.5 years now I got my GC and I still have another 2.5 years to go before I could file for my citizenship.

Thats is why I have been looking for somebody here in the US who is either a citizen or a permanent resident or who is already a H1 visa holder. But, unfoturnate cannot find the right person.

But, thank you guys for all the input. Nothing is in my hands, put my trust in god and will wait to find the right person.
