Has anyone had problems w/ TN at border while I140 approved/pending?

I already know that application for I140 does not constitute an immigrant intent. However some border bullies may give you a hard time for a TN application if you have an approved or pending I140.

I just want to know if anyone has ever had any problems getting a TN with a pending/approved I140.
 
There was an incident

A couple one of whom is my friend, once came across U.S.-Canada border on TN visas, the U.S.custom officer asked if they had applied for permanent residency and said if that was the case they needed to switch to H-1 in order to be admitted.
 
"applied for permanent residency" is by definition I-485.

This thread is aking about I-140 ONLY.

By the way, H1 is not the only waty to be admitted once one has applied for residency, of course. AP will work just fine to enter, and EAD to work. Both become available as soon as you have applied for I-485.

Nelsona is right, sorry I equated I-140 with I-485.

In my friend's case, they answered "yes" when the U.S. officer asked if they had applied for green card even though they were only in the I-140 stage. The officer just gave them a warning but still let them in on TN visa.

That happened at Detroit-Windsor port.
