Hi .. This is for my freinds h4b visa.

My friends family went to chennai for h4b stamping on Aug 29 2003.they have not issued visa. They are asking them to furnish 3 yrs paystubs and all w2 forms. He has 2001 ,2002 with little income. He didnt work for one and half years, and he was in India for 6 months in 2002.Now he has a very good job and he filed his taxes for 2003. Now he has visa extension up to Nov 2006. The old employer didnt give him any bench period salary because of market situation. Now my friend moved to new employer (new h1b).

This is what they are asking now. "'with letter from company explaining why so little income". 221(g).
what explanation should he take from his old employer.
Can any body help in this situation.. They were separated almost 4 years. can they re apply what ever they have now?

Let him male a complaint against the employer who did not pay him while he worked with him BENCH or TABLE is NOT allowed. DOL will recover his wages and will let your friend know how to collect it from DOL. Read below:

He changed his employer also.

----- he has to explain, better he should contact a lawyer
