H4-Visa Stamping : Please Help

Hi All,
I need a help on H4 Visa re-stamping.

Myself and my wife have H1 and H4 stamping on our Passport till December 2001.I changed my company in March 2001 and have valid H1(myself) and H4(my wife) (797) till Jan 2004 from new company. We have not travel outside country after that hence didnot need to stamp passports with the new visa.
My wife is planning to visit India next month.
The question i have is

1. Is there any problem for H-4 Stamping for my wife, while my H1 stamping on passport is not done.Is my 797 and supporting papers good enough for her passport stamping.

2. Can she go to any US consulate in India for stamping ?

3. What documents she should carry for stamping.

No need of H1 visa stamp. You can give a letter to US consulate requesting H4 stamp, saying you are busy with work and request H4 stamping. Might have to give copy of your passport to prove that you are really busy and do not have time to make a trip to home country to get stamp.
Can also use DOS proclaimation about non requirement of renewal stamps..

I have a similar question. My self and my wife are here on J1 and J2 respectively. Then I got J1 waiver and changed status to H1-b. My wife is on H4. We never traveled outside USA so we did not got a chance to get visa stamp.

My wife went to India and planning to get her H4 to come to USA. I gave all the necesaary documents like employment letter, my H1-B approval notice, my J1 waiver, last three pay stubs, 2002 earning statemnt (W2) as proof of continued employment etc. She sent in her application for H4 and waiting for the last two weeks.

Mean while I came across a post that says it is necessary for me to have my H1-B visa stamped first in order to my wife get her H4.

I have no idea about this twist and it is extremely difficult for mr to make a trip now. Any guess about her pending H4 application and ways to handle this. Is it absolutely necessary to have H1-b visa stamp before a H4 or they deal with them on a case by case basis.

Any information is greatly appreciated, Thank you in advance.
