H4 Visa Revalidation - Need Help - Urgent

All help is appreciated - Question on H4 - Does it need the spouse's current valid visa ? Or Is current valid I - 797 ok for sending it for revalidation ?

Does it need the spouse's current valid visa?
----If her H4 visa stamp is NOT expired more then 1 year in passport she can send her passport for H4 visa stamp, she needs currant H4 extension approval to be sent and primary H1 holders h1b approval notice, and copy I-94( front and back and other required documents. Read the complete info:

Thanks a bunch for the response. The principal alien's h1 is sent for revalidation about two months ago to St. Louis as the previous H1 visa has expired. So does the documentation for H4 revalidation require the H1 revalidated visa copy ? Response is appreciated

A valid I-797 for H4 approval and a copy of valid I-797 of the principal's H1 is all that is required. It is not necessary for the principal to have a valid H1 visa stamp in order for the dependent to get a visa.

As per travel.state.gov web site:
'If the spouse and/or dependent children are applying for visas separately from the principal alien, submit certified copies of the principal alien’s VALID visa and valid I-94 (front and back) in addition to the other listed requirements.'
The above implies that the documentation to be sent
for spouse/dep. visa revalidation,to contain 'Valid Visa' copy
of principal obviously? Since again dep. revalidation mentions, based on havimg only on 'vaild visa' of principal.

from the previous post we came to know that even though you dont have a form I797 for H4 you will get stamp for H4 if you are applying along with primary H1 .
 
Please check the web site:travel.state.gov/hlop.html.
Also, for example,if spouse I94 already expired,if he/she
doesn't have an extesion of I94(consequent of new I797 ),
the spouse will become out of status (as the I94s are again ,individually granted for each person at POE etc).
So check carefully for all the documents relevant. and extensions

Yes as participant said..
if if spouce is applying separately she must need the extension papers . and ofcourse primary applicant I-797.

What in the case of the applying both ..
Do we still has to have the H4 I-797?
what we came to know that from the previous post .. several of our guys .. did't send the H4 I-797 ..Becasue they dont have it ..
*ofcourse they applied I-539 for extension .. they might be thinking that extension will come anyway ..
But still they got their H4s stamped when they submit along with the primary applicant means along with the H1..
