I am on an H1-B visa, and I switched jobs in mid-September 2004. the H1B transfer was approved, and the expiry date was extended from May 2005 to September 2007 (3 years from the date of application)
My wife, whose H-4 visa was originally stamped as expiring in May 2005 (just like mine was) came to the US in September 2004. Her paperwork was not submitted for transfer when I applied for the H1B transfer.
Question is: now we are in July 2005, and the stamp in her passport expired in May 2005. is she technically out of status?Or can she just show a copy of my I-797 so long as she is in the country? (Of course, once she goes back home, she will go to the US Consulate for a renewal of the H4 visa)
