I got my H1 Visa stamped in Jan' 2005. My wife and children did appear for the H4 Visa at the Chennai Embassy last week and were denied the Visa. The Consulate General was asking them an explanation as to why they did not appear at the Embassy along with me. They want an explanation from me and my company and then come back to the Embassy again for the approval.

I came to US about 2 weeks back. What is the best explanation that I or my Company can give regarding this issue?

Any help in this regard is highly appreciated.

Thanks,

It is just harassment, no law/memo from DOS says that H4 holders should appear to get H4 visa the same day with H1 holder. Why one needs to give any explanation why the dependents did not appear the same day with H1 holder? Why the employer needs to explain? A person can be sick, may be not feeling well, may be visiting old or sick relative, may be the child did not wanted to miss a class. If your employer has a good attorney let the attorney write a strong letter stating that one do not have to explain to US consulate or consular officer why dependents did not appear the H4 same day with the primary H1 holder, no such instructions have been given by DOS to persons who apply H1 or for dependents who apply H4 visa stamp.

Show some good personal reason like health problem, not relieved from work or some more family / property things to be taken care. Never say that you thought of taking your wife after you getting a job or settling down.
