H4 Visa in Chennai consulate

Hey gurus pleaase give me advice

i am working for company A and got peteitioned approved during Nov 2003, and then send it for revalidation ( revalidation is received ),
meanwhile after sending the papers for revalidation company A reduced salary and filed amendment to the petetion. which is pending with Texas service center

I have applied for H4 for my minor son in chennai consulate, but chennai consulate wants the physical presense of both the parents,( they did not specify any documentation )

company is refusing to give the vacation and leave.
wife is going to india during May, 2004
then what should be my couse of action to get my son here
can she attend the consulate and say that company is refusing to give the vacation, company can provide any sort of documentation and help


your help in this is appreciated

---- It seems that Chennai and now Bombay they want to torture many.
Company is refusing to give the vacation and leave.
--------- Here is my suggestion: 1 Get letter from employer on his company letter head that they have lot of work and cannot give you leave at this time (employer can write the better language than me or company lawyer can help)
2 make an affidavit that your wife (name, DOB, Passport #) is visiting US consulate for your minor son (name, DOB, PP#) H4 Visa stamp and you are unable Visit India at this time due to work. You do not have any objection to your Son H4 Visa stamp and your wife (Name as on Passport) is legal guardian/ parent/biological mother of your son XYX and your son can travel to US with your wife (name) and you don’t have any objection.
** go to Bank get the affidavit notarized so that wife can take it with her

--- do the above and she can present the documents if asked

I have another doub, do I have to wait till the receipt of the amendment to the petetion or shall i proceed with the exisiting one.( approval might take 4 months to receive that )

----- Your wife is going in MAY if you get new amended H1 approval notice then send new if not received then send the current notice, it depend on when your wife goes with kid to consulate and what is your latest H1 approval, she should take the latest approval to consulate for your son H4 Visa stamp
