A 10 year B1/B2 multiple entry has been issues. Only B1 has been used so far. Can one apply for a H4 now without the B1/B2 being cancelled? I am afraid the US embassy will cancel the B1/B2 when you apply for a H4. Any links to resources stating the legal standpoint is greatly appreciated

One can have only one type of non-immigrant visa at a time (B/F/H/L etc).
If you get H4 , your B will get cancelled.

I know someone who has both F and L visa stamped. Is this an oversight by the embassy?

Yes, visa stamped on top there is a small rubber stamp "CANCELLED WITHOUT PREJUDICE"

PREVIOUSLY STAMPED ONE TYPE VISA IN THE PP REMAIN THERE , CONSULATE WILL NOT TEAR OFF THE PAGE, THEY SIMPLY PUT LIGHT RUBBER STAMP AS NOTED ABOVE.

Hi

Great Guru was right! One can only possess a visa stamping for the relevant category say B1/B2 or H4. The H4 application has to be made in a proper fashion keeping the consulate trend in mind.

just a query

hello there,
what if the above h4 visa is denied for any reason , ten will it have any ill effect on already issued b1/b2????
moreover if h4 expires in 1 -2 years then b1/b2 will hold good or it will be deemed cancelled once forever??
and even if cancelled for all what are the chances of getting b1/b2 again??? same , increasedor decreased??

Hi,
Ur B1/B2 will be stamped " Cancelled without Prejudice" only if ur H4 is issued. And if ur H4 expires, u will have to apply for the relevant visa depending on ur then status. And if u want a B1 / B2 at that point of time, it will be treated as a new case and will be decided on the document u submit and visa interview. You may have a slight edge if u have maitained legal status through out.
