H4 Visa at Chennai consulate respond please

I applied for my wifes H4 and the consulate said they are not convinced about my status. Then our company lawyer contacted the Consulate and she got a response from the consulate and it basically stated that from the investigation it showed to them that i am not working full time.

Now after 5 months and sending the consulate tax returns of all the years in US directly from IRS(fortunately my tax returns are pretty good), we got a letter asking to resubmit the application.

Its been more than two weeks so our lawyer contacted the consulate and we got this response

We acknowledge receipt of the documents submitted by XXXXXXX and are in the process of adjudicating her case. We will contact her as soon as the processing is completed.

What does this mean and how soon can i expect an answer
 
I hope they will send a letter to your wife and she will be issued H4, you involved attorney and it was the best thing.
 
I got my wife's visa(re-submission) after 4 1/2 weeks. So , you should not worry as it is only two weeks now. If I were you, I would not do any thing else and wait till the end of this month. Contacting them again and again could have a negative effect. Good Luck
 
Well my problem is my H1 expires on Sep 03 2003 and am at the end of the 6 year limit. I cannot do the 7th year extension since my I140 is already applroved and also applied for 1485 in december last year

could you please give me more details about your wife visa query, because my wife also having trouble, she got a refusal letter from consulate under 221g saying my status is invalid, could you please let me know more detail what you did for this case ? and what your attorney did ?

1) Applied for H4 with copies of I797,I129,LCA, Paystubs, Tax returns,Ds-156,marriage certificate,photos,etc
2) After 5 weeks we get a letter which says they are not convinced about my status and rejection under 221g
3) Talked to 4 different lawyers as how to proceed lost 3 weeks
4) Company leagal rep calls the consulate keeps trying for a week(she was great every day she used to come in at 4AM) before she gets to the Vice Consulate General explains the situation and gets the contact of the Cheif of Anit Fraud Unit.
5) Guy is on vacation in US and we were asked to wait.
6) Sent G28 representation. My Grand Parrents ( I have their address on the passport) back in INDIA got a call and were asked about my marriage details and we think thats from the consulate as i know of no one who would be intrested in my marriage details
7) Cheif comes back from vacation and tell us that they think i am working part time. ask us to send last 2 year tax returns directly form IRS by this time 2 1/2months are already gone. Asks us to wait for a month and 1/2 after we request IRS
8)Requested IRS for last 3 year Tax Transcripts. Lawyer sends AFU an advance Copy and asks if they need any other documentation
9) After month and half we contacted the Consulate and They said every thing looks fine and that they donot need any further documents and that they will send my wife a letter asking her to resubmit the application
10) 10 days latter we get a letter from the consulate asking for
DS-156.copy of 1797, Visa Fees, my passport copy and return envolope.
11) Three weeks gone by still waiting.

I am not sure if ur case has anything of this sort
I screwed up big time and am paying the price. We need to submit all out times by the last day of the month and then we get a pay check on the 15 this is done thru ADP. IF u submit your time after the last day. They process it manual and give u a manual check however the amount gets added to YTD in the Next ADP run. I never submitted by time sheets on time so i get two checks every month one from ADP and another manual. so we think this caused all the problems. The guys did not bother to check the YTD or it was too confusing. When i was submitting the H4 application it didnot even strike to my mind that the consulate might think the manual checks are fraud.

My Sal form the latest compnay was 5k less than the LCA when i submitted the application and i moved to this company only in September last year this was due a mistake and was corrected now.but over all i donot have any issues with my LCA's/W2. W2 were always more the LCA. my last year was 20% more than the present LCA due to my previous company earnings

I would check w/ attorney on this - you may be eligible for a 7th year extension.

Hi gurus,
Here is my situation. I am thinking to get marry with my fiancée in December and apply for H4 visa at CHENNAI consulate in January. Since I came to USA, I am working in same company. I landed inUSA in October 2000. I have a valid H1B visa stamped till January 2006. Following is my complete earnings during my stay in USA.

1.Year 2000-Landed in October in USA. showed only one month salary in my W2 form out of 2 months 24days stay in 2000 year.

2.Year 2001- Because of project got scraped I was on bench for 3 months. During this year I earned only 75% of salary (9 pay checks) mentioned on LCA. My employer (Big Fucker) did not pay me on bench so I earned only 75% of salary mentioned in LCA during 2001.

3.Year 2002- This year was good for me and earned 100% of my salary(12 paychecks) mentioned on LCA.

4.Year 2003- I hope this year too good for me and I am quite sure by December I can earn 100% of my salary (12 paychecks) mentioned in LCA.

I am afraid what happens if I apply for H4 visa in CHENNAI for my wife in January 2004. Can you gurus please clarify me following doubts?

1. what you guys think about my situation?

2. will they reject or issue H4 visa to guy like me?

3. Are there any body in same boat and got successful at CHENNAI consulate?

Your help is appreciated. I am in total dilemma and could not able to plan anything. Please Help.....Help........Help................

All I can tell u
I have been in US for 6 years and till date got payed for every day and have filed taxes. My wife is in India for the last five months. Even though we got a reply from the consulate to resubmit the application, its past 3 weeks and we donot have an answer. On the other side i know of few guys who faked their Pay stubs and W2's and got the H4's with out any issue. f
So it all depends on our luck i guess.

zipper I read your situation and cannot help but feel for you. Especially when you mentioned the fact that you have been on the job and getting paid every day. Yes I know there are people out there who get away with fraud and still get their visas. Here is one last option you have in case your wife's h4 is ultimately rejected (hopefully it does not come to that). Switch your GC processing immediately from 485 to CP and then add your wife to the process before you go for the interview. Everything will be ok. goodluck to u.
