H4 to H1B transfer and 7th year extension Please Help!

Hello,

I am currently on H1B . My H1B expires on September 2005 , and will be applying for 7th year extension within 2 months(say June 2005). My wife is on H4 and she got a Job offer from a US company and the company is planning to file for her H1B in say May 2005.(There are minor chances of my wife not getting H1 , because of H1 quota over or say some other issue.)

So when my company applies for H1B (my)extension for 7th year(in June 2005) should they apply for H4 Extension also? Will applying for H1 and H4 extension for the same person simultaneously create any confusion/problem ?

---- YES, inform the lawyer that you need to extend her H4 status
Will applying for H1 and H4 extension for the same person simultaneously create any confusion/problem ?
-----NO problem, you both will get new approvals and I-94 with same expiry date. apply her H4 extension with form I-539 that she has to sign

Following is the reply from my lawyer:

last one approved is what is valid.

So if the H4 is approved last, the H1 status will be invalid.
