H4 to H1B and SSN

Hi,

I came to US on H4 and now I got my H1B approved. It is valid from October 1st 2005. I tried to apply for SSN by visiting the local SSN office, but they didn't accept my application stating that my I-94 in Passport has H4 written on it. They asked to provide a card or new I-94 from INS. I am not sure ow to get the new I-94. All I have is a I-94 in the Notice of Action that i got after my approval.
Any pointers in this regard is highly appreciated.

Did you get H1 approval notice original from your company/attorney?
If yes, see at the bottom, there will be I 94 portion with validity dates.
If you do not see any I 94 portion at the bottom, means your attorney did not change the status from H4 to H1, but applied only new H1. If it is so you have to go out of US and get H1 stamped, and enter US you will get new I 94 with caveat H1 on it. With this I 94 you can apply for SSN to start the job.

Do you have luck in obtaining the SSN? My wife also obtained her H1B with effect from Oct. 1st. We went to the SS office and they said, we need to have a card with a stamp of H1-B on it. My wife got her I-94 along with the 797. I don't know what those guys are looking for.

Hi Murty,
Keep trying.They expect H1 to be like Green Card, as they are not entirely familiar with the rules for H1 visa.Keep your H1 visa petition , the lower portion of which has I-94 and indicates the Class as H1B.Explain/Convince them that only when you travel out of the country you will get another I-94 with H1B stamp on it,Since this is the Change of status from H4 to H1 the I-94 in H1 petition is valid.
 
SSN Help please

I got H-1b valid from 1st Oct 2005, I was on H4, I am located in dallas, TX. Does anyone applied for SSN recently I need SSN as soon as possible not for payroll but background check for my client. How long does it take to get SSN after applied? SSA database will be updated for H-4 to H-1b conversion? I read all the messages I didn't see anyone getting in 1 week. Any information will help us.

We had the same problem today .It was in Troy , MI .In spite of me explaining the officer at the counter over 20 minutes that the I-94 attached below the pettion is a valid one for H1B , she was not convinced. Later i realized that she does not understand the immigration and status change process completely.

Another thing to notice is that the system they use reflect the current status as H4 not H1 .That's another reason they are reluctant to accept the papers.

I guess i have to wait somemore time for this.
 
all you guys are not alone - the INS has screwed up big time on this matter - apparently everyone's status is showing up as 1B1 rather than H1-B - so we have to correct it by writing to Nebraska!
