H4 to H1 without I94

Hello,

I came to US on H4. After coming to US, I had applied for change of status (H4 to H1). My H1 got approved and i got my I797 without I-94 on 1st OCT. I spoke to my employer and my attorney. They say i cannot apply for my SSN till I get my H1 with I-94. They say in order for me to start working in US, i need to get my H1 papers stamped from my home country or Canada or Mexico. My attorney has sent a fax to INS requesting them resend I797 with I-94 attached. However, it has been two weeks since the fax has been sent. But no result as yet.

My attorney has suggested me of going for Expedite Processing for amendment as its INS service error that they have not sent I-94. My question is how much time does expedite processing take? I m interested in getting my I-94 asap. In my case, should i go for expedite processing or premium processing? Which is faster? What are pros n cons of Expedite and Premium Processing? Which will be more beneficial to me?
