H4 to h1 visa

What happens if a person in USA on H-4 visa applies for H-1 visa and the application for H-1 visa is rejected. Is the previous H-4 still valid in this case or the person is out of status ?

Either your employer or your qualification does not allow you to get H1. Unless your stauts is changed from H4 to H1, you are still in H4 and continue to be H4.

Your status will be H-4 Visa & it will valid upto your I-94 expires.
