H4 to H1 tranfer

Hi,

Here's my situation:

I am working for a company A, and by mutual decision, I have to leave the company by end of May. I am having difficulties getting another job which offers H1 transfer. In case I dont get a job by the end of May, my lawyer suggested I should change to H4, and then once I get the job, I can get H1 transfer from my original H1. She said this can be done as long as I get a new job within a year.

Could anyone please let me know if this is valid.

This is another advantage if both of them are holding H1. You can switch back and forth to H1 to h4 to h1 no. of times filing h1 to h4 in timely manner.Here's my situation:
