H4 to H1 question: Work start of date

Hi,

Iam in USA on H4 visa.

I wanted to file my H4 to H1 Change Of Status in premium processing on April//01/2007.

April/01/2007 is the date when the new H1 visas would be available next.

When can i start working then ...what would be my start date on H1 approval notice ?

is it Oct/2007 OR i can start working the next day after H1 approval notice(since i do not need to stamp the visa on my passport to enter USA) ?

If you file April 1, only date you can request is Oct 1.
It is not allowed to start working before Oct 1.
 
I think the condition to start "Oct 1" will remain true even if iam doing M.S degree from a state Univ in USA (on H4 status).

But does my M.S degree based (under the 20,000 advanced degree H1 visas) H1 visa will come under the 6 year cap imposed on me ?

Iam here in USA on H4 since 4 years now. I know the H1 and H4 counter cap is tagged together.

I will be completing my H4 and H1 status in Jan/2008. If i can start working in Oct/2007 then i will get 4 months to work only.


Please advise.

I will be completing my H4 and H1 status in Jan/2008. If i can start working in Oct/2007 then i will get 4 months to work only. YES, only 4 months, some time H1 rejected, the blunder what you have made was, you did not change your H4 visa status to F1

Please advise.
 
Can i change my H4 > F1 visa now i.e in the middle of my MS program (I have completed 24 out of 36 credits)?

And atleast save from now till May/2007 from the counter of H visas.

Also, iam on H4 since 4year+5 months at this time. My husband is already on his 7th year.

can my husband's 7th year extension (his I-140 approved) cause any problems for me getting my F1 ?

You are just playing around with questions, answers, repsonses and postings. Everytime I see an answer to a query you are getting in some new issue. Looks like you a million of them and it is just keeping the forum busy with all kinds of people chipping in their contribution.

What do you want to achieve by all this?

Iam asking some valid questions, if you can not respond to them, please do not discourage me.

Iam very confused after knowing some of the facts and i wanted to learn more and plan the best i can.

Yes. But COS from H4 to F1 some time takes more than 6 months, until then you are in H4 and your H4 getting exhausted that time too.

great guru .. thanks for all your replies.

From today till Jan/2008 (when my H status expires), i do have atleast an 1 year left. I think if i can try now, i may have chances to do COS from H4 > F1.

1 ) Do you know if F1 is filed by the University or myself ?
2 ) Do i need to go out of US and get F1 stamped on my passport after F1 approval notice in order to be on OPT?

I think these are my last questions on this forum.
