I came to United States for the first time in Jan 2007 on H4 visa.

My employer/sponsor applied my h1b visa on April 2007 and I got H1b approval notice I-797B without I-94 while I was in US .

From the discussions in the forum i have read that I need an I94 with my H1 status to apply for my SSN,i.e to start working

1) Can my employer get the petition amended so that i get my New approval with new I94
2) Do i have to go out of US and get my staming done for my H1 to be valid
3) Legally what status i am in now?h1 or h4??

Hi,
i have a similar situation. how long does it take to get this amended? i thought it would make more sense to get it stamped either in mexico or canada, rather waiting, if it takes long.

Passport Visa

I came back to the US on an H1B visa in September 06. Although all of my other documentation states that my H1B is good till Sept. 09, the visa in my passport expires in Sept. 07 (ie. it has already expired). I have looked at colleagues with H1b's passports and the dates on their passport visas matched their other documentation where mine does not. I have heard that sometimes typos occur on these documents. Has anyone else had this problem?

How is it rectified? USCIS is a nightmare to call!
 
Regarding COS from H4 to H1-B

We have also the same situation . i applied H1 for my wife in 2007 quote and got approved. She entered US with H4 visa in may 2007. In H1 she hasn't had I-94 as she entered late. I applied for Cos on Sep 18th and got receipt number 1 week ago. As the process will take little bit long time. Is there any chance of Appliying for the premium Processing at this point of time. If any one have the idea please let me know. i will be very helpful
 
I am also in the same boat, do you guys know how long it would take to get COS?. Is there a preimium processing for COS if so does anyone know how much is the application fee.
