Hello

I was on H4 when I entered the US. Got my H1B approved last yr and am working since Oct last yr. I did not do any education in US.

I did my B.E. in India and I got my Education Evaluation done in US. Will it be OK to attend the H1 Visa Stamping interview in Canada? I hear mixed responses regarding this.

I just wanted to confirm that me not doing any degree in the US will not negatively impact my chances of getting the H1 visa.

Your assumption is not correct. But keep your education credential evaluation with you. Unless counsel ask anything about your education do not talk about evaluation.

Does it mean, I can still go to Canada for stamping. But granting or rejecting my visa is subjective to the counsel (just like any other H1B applicant who did MS in the US)?

Or are you saying, I am not eligible to go to Canada for an interview at all, but should go to India ?

I am currently on H4 visa and my spouse have applied for his change of employer from Company A to Company B in Apr 2nd week 2007 regular processing. My H1application was filed under premium processing and was approved (known via email) on April 18th 2007.

We did not apply for my H4 visa application (along with my spouse's H1 application throught company B) as I had already filed for my H1 application for Oct-07.

So right now I have two visas: H4 visa till 2010 Jan 31 as a dependent on my spouse's Comapny "A" extended H1 visa which will no longer be valid once he joins Comapny "B" ie new company and my own H1 visa active from Oct 2007 onwards. Also, on my passport I have a visa stamp till 2007, Jan 31, though i have valid H4 status (i-94) because of extended h4 visa .

Having said all this, let me come to my questions:

1. I want to go to India for a month or so and come back before Oct 1 so that I can visit family members before my job starts. Now because my H4 stamp on passport was only valid till 2007, Jan 31, do I need a new stamp?
2. If yes, and if I am planning to come by July beginning to US , does my H4 visa application also needs to be filed from company B..ie my spouse's new company before I visit India?
3. If yes, would it better to convert my spouse's H1 application from regular to premium processing so that when I visit India, say in June beginning for one month.
4. Also(most important question for me), say if I get my H4 visa stamp from India, would it jeopardize my H1 visa which has been approved already.

Also, if anybody is in a similar situation, please reply to this post.

Let me get this straight. You have an expired H-4 visa stamp and an approved H-1B petition? To re-enter the US, you will need a new visa stamp. Depending on when you apply for the visa, it can be for an H-4 or an H-1B visa.
