My H1 is valid until 2006. My spouse came to USA in 2002. If she applies for H4 to H1 conversion, Will her H1 be valid until 2006 (the same day as mine is valid upto) or Will she get her share of 6 years i.e., untill 2008.
------------ at one time she can get H1 for maximum 3 years (that depends on LCA validity and what employer asks for many lawyers file for 1 year or 2 year and then again file for extension, so that they can charge the employer again) her H4 stay will be counted toward H1( if she was on H4 for 2 years then she may get H1 for 4 years that makes total 6 years)
