My wife currently living here on H4 visa. Now she has got H1-B Approval notice on March 24th. We have planned to visit India during 3rd, 4th week of April. Which is the best place / Embassy to go for H1 B Stamping ? Can she go to India on H4 and come back on H4 visa and do H1B stamping in Mexico at a later date? If H1B Stamping is rejected in Mexico/Canada, can she return to USA with no hassle? She has Masters in Science from India, 2 years Masters diploma in Computers from a private computer training institute and 3 years IT experience in India. The company she worked during 1994-96 is closed, will it be affected H1B Stamping..? Will the embassy have the copy of resume submitted during H1B submission/petition.

Once H-1B petition gets approved, she is in H-1B status.
So, currently she's in H-1B status(not H-4 status).

You can't re-enter the country with H-4 visa in such case.

Only options would be:
1. try to get it stamped in chennai
2. try to goto canada/mexico to get it stamped before april vacation


You might want to have her work for few months and have paystubs too, before she appears for visa-interview.

About past companies that don't exist, its better to have all possible evidence like paystubs, etc., to the least.

Only safe place for H4 to H1 is Mexico. Dont go to toronto for a H4 to h1. Chennai is a quagmire right now.
