I came to USA on H4 in 2003, applied for my H1 in 2004 and got apporval, however i have not yet started my job nor did i got H1 stamped on my passport. Now i am planning to visit India for a month,When i return back what will happen at port of entry as i dont have my h1 stamped on my passport where as my H4 is stamped on my passport and is valid till 2006.also how to get my h1 cancel and get back on my h4.Thanks a lot in advance

---------- simple, enter US with valid H4 visa stamp and you will get I-94 with H4 status and you will be on H4 status

2004: Did you change the status and got I 94 at the bottom of the H1 approval notice or got a new H1 approval with out I 94 at the bottom?.
If you would have got your I 94 at the bottom of h1 petition which bears your original H4 , I 94 card serial number, your status is changed to H1 and you are no more with H4 status.

BUT if you have valid H4 stamp in passport and your spouse is on valid H1 status you CAN enter on H4 status and you will be admited on H4 status and will get I-94 based on H4
