H4 to EAD to H1

Hi,
One of my friends came here on H4 Visa.He started working on EAD since 2 years.Can he file for new H1? I 485 is still pending. Will he lose the 485 if he gets divorced?

Please help me finding a solution. If he can go for a new H1, we want to file for one in this Cap for which we dont have much time left with.
