H4 to EAD and wanted to apply for H1

I came here on H4 and started using EAD(got through my husband).My H4 got expired and I never applied for extension since I am using my EAD. I wanted to apply for H1 this year(2009-2010).Am I eligible to apply for H1 becuse I am on my EAD and my H4 is expired.please help me out with your answers.

you came to US on H4 status and you file I-485 then got EAD and worked on EAD and did not file H4 extension. what is the status of your spouse? I know that is I-485 pending is he on H1 status or used EAD.
explain why do you want US employer to file H1 for you when you have Pending derivative I-485.
