H4 rejection

Hi

My wife's h4 got rejected under 214(b).Seems very weird but true.Should i reapply or consult immigration lawyer ?

I want H4 visa and I have been trying for it from Nov 10th 2010. They gave me orange slip at Kolkata asking for LCA and Bank statements inspite of already submitting 6 months bank statement.

My Husband is a contractor.

His visa got expired on April 2010 and he changed his employer in May and got his I797 only in Sept 2010 and he sent me documents and I applied for H4 on 10th Nov 2010.

The Consular was not satisfied with my documents he felt that his H1B sponsors are not paying him correcly or so and so he asked for LCA and Bank statements showing his December account balance.

I took them and submitted on 21st Dec 2010 and he still is not satisfied he says that he doesnt see his employer paying him on the bank statements??

They talked to my husband and also asked an email from him about his paystubs.

They have taken my passport and asked me not to contact them as they will contact me.

What do i do if that gets rejected??
 
Is there a paper trail showing your husband being paid regularly by his employer? If so, it can be easily matched to deposits on the bank statements.

I took them and submitted on 21st Dec 2010 and he still is not satisfied he says that he doesnt see his employer paying him on the bank statements??

The reason why the consular cannot see any deposits made by my husband's employer on transaction sheet is because then his visa was under process it got approved only by September and from next month ie october he joined a new project
However from November we were able to show the deposits made by the employer and we did . now that seems like not enough.

214(b) rejection converted to 221(g)

hi,

My spouse's h4 214(b) rejection has been converted to 221(g) now.Consulate relaised the mistake and corrected in next application.I consulated one known law firm in NJ and they didn't do anything for long even i was paying huge amt.I dropped the case from them and reapplied again with exact same docs.

you should contact Cyrus Mehta he is lawyer in NYC(www.cyrusmehta.com) and one of his lawyer is in India and I think her name is Poorvi Chotani in Bombay. He is good dealing with Consulates in India.
