Hi,

My OPT expired on Jan 9, 2006 and I am using my grace period now. I have the Receipt of Action for H4 visa from DOHS. It will take a couple of more months until I get the approval. Will I be in-status if I stay here with the H4 notice?

My employer is going to apply for my H1B on April 1. What happens if I still don't receive the H4 approval by then? Can I apply for H1B with the H4 notice to show the status?

Please suggest me.

Thanks.

As for as you file H4 and have valid receipt you are in status until it get approved. if any case yur h4 is rejected, then your overstay will be a question for future visas.

Thank you very much, great_guru. Would you please post your valuable comments for my second question? I always feel confident after reading your replies.

My employer is going to apply for my H1B on April 1. What happens if I still don't receive the H4 approval by then? Can I apply for H1B with the H4 notice to show the current status? Or how is it going to work?

Thanks.
