I am on an F1 student visa. I would like to change my status from F1 to H4.
My husband is currently changing employers; he filed the I-129 form 2 weeks ago and has the receipt number. Since his application is pending we do not have the approval notice yet. Now I would like to file I-539 for the change of status from F1 to H4.

1) What are the documents I should enclose?
2) Form I 539: It asks if I was employed in the U.S-- since I was a student all through, the answer is NO to that question (I had teaching/research assistantship throughout). As for the explanation about how you are supporting yourself : My husband plans to start working in the new company only 2 weeks from now and he will not have a pay stub from the new firm for me enclose as a proof.
a. Can I enclose a letter from my husband’s new company with his salary they are going to pay as a proof? (He will start the new employment in two weeks.)
b. Should I enclose paystubs from my husband’s current job? (He will be working for his current employer for another two weeks.)
c. Should I also say I had assistantship from school until May 21st; just as an additional proof of how I supported myself during my F1?

3) I have a valid I-20 though my F1visa stamp in the passport says it expires on June1st 2004. I-94 says date valid D/S. Should I enclose my I-20 documents from the current school and old school I attended?
4) Notarized Indian marriage certificate will do as proof of marriage?

1. Husband's H1 (old), New H1 receipt, marriage certificate, husband's old paystubs, letter from husband's company confirmiong employment and request to process your H4...
2.a ,b and 2003 W-2. Dont mention studentship. You cannot receive studentship while on H4.
3. To prove validity of status yes.
4. yes will do.

Please let us know how long does it take to chanhe of status from F1 to H4 within USA. If you travel to your home country , you have to get H4 VISA there after july 16, Is n't this true?
