I am on an F1 student visa. I would like to change my status from F1 to H4.
My husband is currently changing employers; he filed the I-129 form 2 weeks ago and has the receipt number. Since his application is pending we do not have the approval notice yet. Now I would like to file I-539 for the change of status from F1 to H4.
1) What are the documents I should enclose?
2) Form I 539: It asks if I was employed in the U.S-- since I was a student all through, the answer is NO to that question (I had teaching/research assistantship throughout). As for the explanation about how you are supporting yourself : My husband plans to start working in the new company only 2 weeks from now and he will not have a pay stub from the new firm for me enclose as a proof.
a. Can I enclose a letter from my husband’s new company with his salary they are going to pay as a proof? (He will start the new employment in two weeks.)
b. Should I enclose paystubs from my husband’s current job? (He will be working for his current employer for another two weeks.)
c. Should I also say I had assistantship from school until May 21st; just as an additional proof of how I supported myself during my F1?
3) I have a valid I-20 though my F1visa stamp in the passport says it expires on June1st 2004. I-94 says date valid D/S. Should I enclose my I-20 documents from the current school and old school I attended?
4) Notarized Indian marriage certificate will do as proof of marriage?
