H4 query

Hi,
My wife went for H4 visa interview at chennai,I have a very less amount on 2002 W2 form and my 2003 W2 form has a good amount on it,the visa offcier
during the interview asked my wife about 2002 w2 form and after reviewing it he said that We can't give you the visa as the amount is too less in 2002 W2 form,and it shows that your husbands salary is below poverty line,come after some period when he has an increase in salary,but presently my salary was very good and i cannt get an increase in my current salary until next year mid,although my current salary is above 65K he does'nt agreed with that even my wife showed him my paystubs and appointment order also.Does any one have this type of queries,please help me,all suggestions are welcome.

Simple, if you were paid less than what your employer promised in your LCA, you/your dependents will not be issued a visa. That has been the policy of many US consulates, including Chennai. By not paying you what the employer PROMISED under oath (in LCA) your employer violated terms of your H1.
 
visu, can u tell me if your wife had to change the last name on her passport before appearing for the visa interview? i am wondering how can that be done so fast especially if she has to join you when u go back to US?

----- get letter from employer why he paid less than LCA let them explain on letter to US consulate or take the help of company lawyer

I have my wife's H4 interview scheduled in March 2005, in chennai Consulate and my 2004 W2 has less than LCA and 2003 W2.

2004 W2 has 48K and LCA states 61K.

I got an employee letter which states that My salary is less because of my two month vacation in India and reduction in bill rate from client.

I can also provide the proof that i was in india two months as passport has that information.

Do i need to provide any other supporting docs to consulate ?

Please let me know your valuable suggestions .

The vacation idea will work of you can prove absence for 2 months but I doubt the reduction in billing rate argument will be accepted. When your employer filed LCA for you he promised under oath to pay you X dollars per year. Your salary was not tied to the employer receiving payments, etc. If he did not pay you as promised it will be seen as a violation of the h1 requirements. US consulates specially in India have been scrutinizing actual salary vs. promised LCA salary and are refusing visas if any violations are found.
