H4 I94 Expired

Hi,

My wife's I94 expired on 11th June 2006.

Her 180 days of over stay ends on 10th Dec 2006.

But i got her H4 extended along with my H1 and the I94 that the INS has issued is from 22nd Dec 2006. ( 21st Dec 2006 was when my H1 was getting over )

I had also applied the I539 for my wife so that the INS can give a statement that her I94 is valid from June 2006 to currrent date. But in the approval notice they have not stated anything with regard to that.

So i have a confusion now as to send my wife to india as soon as possible or can she stay in the US since her I94 is valid from 22nd Dec 2006.

Please advice if any of you were in this strange situation.

--------------did you file her H4 extension with form I-539 BEFORE 11th June 2006??? did she got her H4 extension approval with I-94 attached(lower right side)? if she has valid I-94 she can stay

-------------- your H1 was valid till 21st Dec 2006, she should have also her H4 based I-94 valid till 21st Dec 2006, why she had her I-94 valid till 11th June 2006?????

-------------if they have extended her H4 and she got I-94 attached with her H4 extension approval then why you want "statement from USCIS" do you mean that her H4 extension is from 22nd DEC 2006??
So i have a confusion now as to send my wife to india as soon as possible or can she stay in the US since her I94 is valid from 22nd Dec 2006.

Sorry for the confusing Mail.

1) My wife's H4 I94 expired on 11th June 2006. ( I did a mistake of not extending her I94 )

2) I applied for her extension only on 15th Nov 2006. I had applied for my H1B extension when i changed my job last year FEB (2005) and my H1 and I94 is valid till 21st Dec 2006.

3) I have got an approval from INS for her H4 with the I94 effective from 22nd Dec 2006 onwards and also my I94 & H1B extended from 22nd Dec to three years from then.

So what do you say of the status of hers now. Should she go back to India as soon as possible since her 180 days of over stay is approaching or can she stay in the US since we have approved I94 from 22nd Dec 2006 onwards.

--------------- your wife is staying illegaly in US after her I-94 expired. if the start date of her new I-94 is from 22nd Dec 2006 then talk to your lawyer for more info.

*** why your wife had I-94 valid till 11th June 2006? it should be valid till 22nd Dec 2006(as your H1 was valid till that date).
