Can anyone please help me with this. I recently got married and came back to US on my H1B visa.
My wife tried to get her H4 from Mumbai [India] and they said they cannot issue her a visa because she had over-stayed on her previous trip to the US. She had applied for a change of status from Visitor visa to Student visa, then and on denial she went back to India.
This time she was informed that they understand the genuinity of the case however they need to discuss this with Washington.
Is anyone aware of this process of discussing the case with Washington?

It happened with wife of my friend she went to get second time H4 visa stamp from Mumbai. She had got earlier H4 visa stamped from Mumbai and stayed in US on H4 visa, no overstay. She sent H4 visa stamping application from Ahmdabad , she was called for interview , she went for interview they just asked the info about the employer of her husband, like how many are working on H1b status with same employer and she said she does NOT know how many employees are on H1 or GC holder with her husband employer. Then she was told that they cannot issue H4 visa and will contact her later as they have to send some enquiry with DOS in US. She waited for 2 month after Interview and then received a letter that bring your Passport and fee Draft for Rupees XXXX on ABC date. She got the H4 visa stamp and is back to US. Hope this helps.

My wife is still on a hold after almost 5 weeks from her initial approach to the US Consulate to get an H-4 visa.

Does anyone know if there is a way we can contact the embassy to inquire about what exactly are they waiting for to grant her a visa ?
