My wife applied for H1b status while on H4. She has a US MBA. Her sponsoring company applied for the H1 using Premium Processing. The job is that of a Project Analyst.
An Evidence Request form was sent back from the INS(or the new name I forget):
This is what they have asked for:
1. Evidence that the job is a specialty occupation.
2. How many individuals work in the company in a similar occupation.
3. Submit a copy of the job posting.
4. Submit a detailed statement of the duties and responsibilities.
5. Explain how your company can justify this position (small company of 10)
6. Submit evidence that the company has sufficient work.
Everything seems to be clear except for Question #3. What kind of job posting are these folks referring to ? H1B does not need to be advertised was my understanding.
Any ideas to interpreting Question 3 would be helpful.
