H4 - H1

Hi,

I have a question regarding H4-H1 issue. Iam on H4 right now and I applied for H1 ( through a consulting company ), got the approval along with I-94 just few days back. I have urgent family matter that I need to attend to in hyderabad.
Can I go to India and come back with H4 stamping at Consulate in India and convert to H1 by joining a job once Iam back in US.

Currently, I can't work until I get my SSN and get my first contract job . Since, I don't have any paystub I won't easily get a H1 stamping in india or other US consulates.

Please advice me what to do.

Now you are H1 no more H4. If you use your H4 while entering (i doubt at POE may be object or reject it), you may not able to use your approved H1 at all.

------------- if your spouse is on H1 then you can enter on H4 and can get H4 visa stamp or if you have valid H4 visa stamp you can enter on H4. if you enter US on H4 you canot work on H4. if you want to work get H1 stamp and enter on H1 status
