Here is the Scenario
0. My 6 year H1 period ends on Nov 2004
1. My wife came to US on H4 visa in may 2004.
At this point I and my wife have Visas stamped until Nov 2004.
2. In July, We applied for my 7th yr H1,H4 extension from Nov 2004 to Nov 2005 and got approved.
3. In october my wife got H1b visa through a company for 3 yrs
4. In Jan she applied for social security number and got the same in March. she hasn't worked for that company and has not received any paystubs or W2s.
5. She is planning to go to india in May 2005.

now here are the questions
1. Can she get her H4 stamp with the approval we got until Nov 2005 without any problems
2. What will happen to the social security no, can we continue to use it for Banking and other purposes.
3. After she gets back on H4 to US, can we apply for another H1 visa without any problems.

PS.
we didnot do change any status change from H1 to H4 or viceversa.

In Jan she applied for social security number and got the same in March. she hasn't worked for that company and has not received any paystubs or W2s. (Having h1 not working for the sponser means, she looses the status. She is practically out of status. You should have changed the status to H4))5. She is planning to go to india in May 2005.

now here are the questions
1. Can she get her H4 stamp with the approval we got until Nov 2005 without any problems. [ Per INS system : Her stauts is changed to H1, no more H4]
2. What will happen to the social security no, can we continue to use it for Banking and other purposes.{Because her status is chaged to H1, she got SSN other wise, SSA will not give SSN. So Social Security Administration verified with INS, that her status is H1, upon confirmation they issued SSN]3. After she gets back on H4 (she can not stamp H4 in India)to US, can we apply for another H1 visa without any problems.(You can apply another H1 provided she has suffienct paystub to prove that she was in h1 status)
