I have a question regarding H4-H1-H4-H1. I would appreciate if anyone can answer my question.
Lets take a scenario. A person on H4(has never been on H1 before) applies for a new H1 ,works on the H1 for 2 months and then goes back on to a H4. Now 1 yr down the line , the applicant wants to go back to work. The questions I have here are
1. Will the second H1-B be counted against the cap.
2.Does this (approval of the second H1-B) have to be with the same company or it can be with any other company.
3. What happens if the previous company has cancelled the H1-B.
4. Is the new H1-B approval process totally independent of the prev company.
5. Also is there any documentation or law from which the above follows.
