H4 entry

Hi,

(1) My wife has valid H4 visa in her passport valid until next year and she is in India now. While my wife was in India I changed my employer. She is going to arrive after a week. At the airport will she have any problem because I’ve changed my job? (Because Her H4 reflects information about my previous employment.)

(2) When I changed my job I got new I 797 approval, which is valid until 2007. I sent a copy of that to my wife. Should my wife show that approval to the officer and mention about my job change situation to him or she can just show her valid H4 visa and enter in usa without mentioning anything unless the officer asks.

----- 1.you should send your Orignal H1 approval that is valid till 2007,at POE she will show passport Visa that reflects past employer info AND your H1 approval notice and will get I-94 till 2007.
2. if she ONLY shows passport Visa she will get I-94 till Visa expiry date and you need to file her H4 extension when she reaches USA with form I-539 BEFORE her I-94 gets expired.
** Check her I-94 expiry date when she reaches USA, so that you file her H4 extension before her I-94 expires

(1)I made a mistake and its too late to send my original approval notice because she is going to leave in 3 days. Now in this scenario what should she do?


(2)She is still studying in India and coming here for 3 weeks only and then going back to india.In this scenario now should she show even the copy of I797 or not?

(3)If i had sent her original I797 then at POE she would have shown passport Visa that reflects past employer info AND my H1 approval notice and would have got I-94 till 2007.Then in that scenairo we don't need to file her H4 extension after she enters usa because her I94 already reflects date of 2007?
