H4 approval after using EAD

Hello all,

In June 2006 I filed my H1 ext (3 year on basis of 140 approval) along with H4 for my wife. Since I filed in Premium I got approval in two weeks. But my wife didn't receive H4 approval at that time.

But same time she got job and we switched her to EAD, so I didn't bother about H4 pending.( By the way her previous H4 expired in June 20th 2006 )

Now in last week we got her H4 approval. Now I am confused.

1) What will be her current status H4 or EAD?
2) Can we check her current status on USCIS records? Is there any number?

Since I am visiting India in Jan 2007 and planning to use AP for her, I want to make sure she do not need to get VISA for re-entering.

I am getting my H1 stamping . Does my wife need to get H4 stamping as well?


It will be great help if I get answer to these questions.

--------------if H4 extension is approved AFTER her use of EAD and USCIS approved her H4 extension then she is on H4 status

-------------- if she has valid AP she can enter with valid AP. as she got H4 approval and you are on H1 status she can also get H4 visa stamp
I am getting my H1 stamping .
Does my wife need to get H4 stamping as well?

As I understand, we can keep H4 and EAD together. But once you use EAD you are on EAD only and to change it H4 you will need to leave the country and get H4. Am I right?

So in this case, how come her EAD become invalid?

My problem she is working and I want to make sure she maintains EAD/AP status to continue working. What can I do for this?

The H4 approval didn't invalidate her EAD. The following day when she went to work, her H4 status autommatically ceased and she reverted back to being an adjustee.

EAD isn't a status.

I called USCIS and confirm that she still can continue to work and H4 approval doesn't invalidate EAD.
