hi

I have 2 emplyers who are going to file a petition for my h1b visa next week.
I am going to work for either a garment retail store A/ garment importer B

I do not have a degree but have 12+ years of experience in garments.
Can guru please hep me and answer the following queries for me :

1) What are my chances of getting the H1b considering i have no degree.
I only am 10th std pass.

2)I am presently in the states on a b1/b2 visa, shld i tell my prospective employers to file a petition for me after i go back to india ? For employer A and B

3)Do you think that is a better option as against staying here and going to india/canada/mexico for stamping if h1b gets approved , as employer B requires me to travel for work regularly ?

3)Or shld I just stay in the states get the petition approved apply for change change of status if petition gets appvd for employer A

Can you please suggest which of these is a beeter option for me as I need to know soon to make a decision soon

Thanx in advance

It is very hard to qualify even without out High School graduation. (12th Grade).

Even if your attorney get you a H1 approval on speciality occupation ( i doubt, if your garments mfg qualify), cousel officer will not stamp your visa.

Even some time people having 3 yrs degree like BCom, Bsc face problem getting H1 approved.

I think your sponsor must consult a very good Immigration attorney before filing your H1.
I know Sheepherder Occupation qualify H classification but no need of any education.

Thanx guru

So you think that getting a H1b visa for me is difficult.
My atorney says I have a 50-50 chance.
But incase at the time of stamping my visa goes into a security check then even my b1/b2 would be in jeopardy.
What do you suggest should I take the risk?

Can you please suggest another visa or option I can use to stay and work legally in the states.

My wife has her green card.

I would appreciate a reply soon.
Thnax in advance again.
