My employer till now did not send me for stamping nor even relieving me. I want to know the validity of my H1B pick like within what period I need to go for stamping after it gets picked up. And when will it get expired, if am not going for stamping.

You have no H1B employer at this time. You do not qualify for stamping. The approval notice has period of validity.

I appreciate for your reply. But am sorry to say that I did not get clarity.
You said that I have no H1B employer at this time. But the consultant through which I applied my H1, is my employer.
And can you tell what is the period of validity for approved H1B (in lottery pick)?

Hi,

I need some urgent help regarding the following issue.

I stay in India. I applied for H1B visa in 2008 quota through an employer.
-------- it was US employer who filed H1 for you
My application got picked in the lottery system and am having my WAC number.
My employer till now did not send me for stamping
-----it simply means US employer does not have job for you and did not sent you the H1 approval notice with Certified Petition copy for Visa stamping. If your employer was consulting company then they may not be able to get contract job and they don’t want you to come to US as they don’t have job

nor even relieving me.
------What do you mean by "relieving me" ? you ARE free and do your job in India or where you get the job US employer who filed H1 for you have nothing to do with your job in India
I want to know the validity of my H1B pick like within what period I need to go for stamping after it gets picked up. And when will it get expired, if am not going for stamping.
--------------- if the employer does not have job for you in US then you cant get Visa stamp.
Thanks in advance.
How much did you pay them to file H1? paid in India?

Yes I paid in India. It was around 1.5lacs INR.
The problem is not about job. The Consultant is not giving the money back and telling that I need to wait for some more time to go for stamping.
Actually the main office of this consultant is in USA. From India, he sent my H1 related papers to USA.
Now when I ask to give my money back, he is asking me to wait till they get relevant papers for stamping from USA office.
So I want to know the validity of my H1 pick like within what duration I need to attend for stamping after my H1 application got picked.

Yes, I agree that US employer doesn't have a job for me now.
Relieving me means I want my money back.

Please help me out.

Buying a US visa is against US law. There are a limited number of fees a prospective employee may pay including attorney's fees. Attorney's fees are for services rendered to prepare the application and would not be refunded.

Your employer cannot provide information required for entry unless he actually has work for you. If he does not - which is quite likely due to the US economy (10% unemployment is a very large number of highly qualified people looking for work), he is correct is refusing to supply you with documents.

An approval is not a guarantee of a job.

------ you did a mistake by paying them and they will not return your money. They are mostly from Andhra Pradeh and have cheated many like you. They post the advts in India papers and somebody collets money for them.

------------To be honest with you the US employer has no job for you and US office of that employer is not sending you the papers for Visa stamping as they don’t want you to come to US. FYI at this time many who are on H1 are facing problems for job as economy is not good and US companies prefer to hire US citizens or Green Card holders. So I want to know the validity of my H1 pick like within what duration I need to attend for stamping after my H1 application got picked.

--did you post here before paying to him? we cant get your money back. you have Indian Police and others means to recover your money from him. seek help from Indian Police(Police may also want money from you to get your money back)/ your friends in India
Please help me out.
---------------Sorry we cant help in that matter.

Thanks for all your replies.
But I want to know whether is there any validity period for my H1 application pick?
Is there any such limitation like an applicant should go for stamping within this period after it got picked?

If I can get answer for this, it will be helpful.

Thank you.
