I am currently in the process of transfering my H1B from company A to B. My H1B is valid until 2010 so I have no problem in that respect, but have a few questions.
1) Company A & B are in the same industry. My job profile is fairly similar, not identical. If I look on my I-292 petition, my LCA and industry number would probably be the same. In this case, what are the chances that my transfer petition will be denied? And in general, how often are H1B transfers denied?
With the American Competitive Act, I can work with Company B as long as the lawyers file for the transfer. Does the mere existence of this law mean that most H1B transfers are approved?
2) I am starting with Company B one week after the lawyers file for the H1B transfer, via premium processing. When will I receive the receipt notice? Should I wait for the receipt notice before moving to Company B?
