H1B VISA Stamping

I really appreciate the great service in this forum.

I have a quetsion regarding the H1B VISA stamping on my passport.

I have my H1 B VISA stamped on passport with old employer name on it and it expires on May 30th 2004, and i think he didn't revoked my H1B, it is still active.

I recently changed my job and have my new H1B approval petition in hand with I-94 expires on May 27th 2004 ( I came to US on May 28th 1998, so my new employer thought that it would be wise to keep exactly 6 years time frame for H1B, which ends on May 27th 2004)

Questions i have is:

1. Do i need to send my passport to the state department office to have this new employer name appear on my VISA with this slight change in expiration date?

2. Since my old H1B VISA has expiration date which is 3 days more than present H1B, should i just keep the old one? does it matter in processing of Green Cards?

3. I filed for my I-485 recently with my new employer, How big a matter it is to have old employer name on my H1B, Will it cause any unneccessary confusion during my green card stamping process upon approval of I-485?

4. Also, I heard that I-485 , I-765 and AP were going to process at the INS district offices, is that right for employment based categories too? I live in Richmond,Virginia, Would you advise where will they process my cases?

read on..

1) you dont have to ..better if you do.
2) No effect on green card.
3) Nope.
4) No..your applications will go to the service center that serves VA...guess it is VSC.

Thanks

I really appreciate yor quick answers

About my last question though, my attorney sent applications to VSC only , where i got the receipt notices.
I also got a Finger printing app. notice in mail today to go Norfolk,VA to have it done by August. So district offices nothing to do in processing the 485 , 765 petitions?

wrong forum. But still,
You need to go somewhere to do the fingerprinting right?
However dont assume that changing employer (your h1 transfer might trigger this) will not be a problem. You will get a RFE for employment and you need to prove that the new employment offer is simialr to the one for which your I140 was approved.

Otherwise, Yes, you need to do the revalidation before 1 year from expiry of previous employer visa, in order for you to travel freely in and out of US.

The 765/131 s can be processed by local or district offices only if your case is transferred there- 5% of the cases are transferred to local office. If your 765 is not approved within 90 days from receipt date of 765, you can go to the nearest district office to get an interim EAD...

Thanks for the Resp

I filed my I-140 , I-485 and I-765 concurrently with my new employer only. It is all on the name of my new employer only. I used a substitute LC to file for above petitions.
H1B also approved with my new employer.

My question is mor like, is it necceesary to have my H1B visa stamped on my passport by sending the approved I-129 to DEPT. OF STATE, since both my old and new employer I-129 approval notices have almost same expiration dates in May 2004 (30th and 27th)?

no not necessary. But if your 485 is not approved before the h1 visa stamp expiration , you might want to send for h1 revalidation or on a travel outside US get h1 revalidated.
