Hello,
My COS from F1- H1B was filed in Oct,2023. I was laid off 2 weeks after I filed. I just received an RFE regarding my F1 visa category. I don't know if I will get a second RFE concerning my EVC relationship, which now I currently do not hold since I was laid off. My attorney is saying that if I receive RFE2 regarding job letters he is not going to fight my case since he doesn't have enough evidence to. Even if I do not receive an RFE, he is saying that my F1 visa would be revoked and I would likely get consular processing and I need to go back to my home country get my visa stamped and re enter US again - in that situation as well, I would need a job which I currently do not have from the past 5 months. Please advise. Thanks!
