H1b Transfer

Hi All,

Please advise me on H1b transfer issue.

I came to US on F1 visa in 2005 and converted to H1b under Master's quota. My OPT was valid through 30 Dec 2008. H1b got approved and is effective from Oct 1, 2008.

I am currently working through a consulting firm. I started working with current client in Dec 2008. I don't have W2 for 2008 as I started working from 1 Dec 2008. I have very good job offer from an american consultant firm and they are willing to transfer my H1b.

I have all paystub since Dec 2008. Do you think not having W2 for 2008 will be a problem in H1b transfer.

Your help is greatly appriciated.

Not having W2 for 2008 will not be a problem for H1 transfer.
From a tax prospective, if you received pay in 2008, you should have a W2. If that paycheck was dagted in Jan, then you are fine.

My client[abc] wants to hire my employee [consultant] and asks that we provide the necessary document for the h1b transfer. As far as I know, we only need to provide the most recent paystub to my employee besides termination letter. Since this is the first time that my client is sponsoring h1b, he wants me to agree tothe following. Please advise?

"The Company hereby also agrees to cooperate and to provide in a timely manner and within the reasonable capacity any and all reasonable and standard required documents/information/authorizations requested by ABC and/or abc’s attorney to complete and related to the transition of this employment and/or H1B visa of the consultant's employee from the Company to abc. The Company agrees not to expect any fees/compensation from abc and/or the consultant's employee for this transition of employment and/or H1B visa"

All you need to provide is a copy of previous H1, which the employee should already have along with a experience letter. The pay stubs should already be with the employee. If you are not getting anything like finder fee, then why do you need to agree to anything? It is between the employee and the new employer.
