I got my H1B in October 2000. Since then I have been working in a university
as a staff scientist. Now I want to go to industry. My question is whether I
need to wait till next year since the cap for 2006 has been used up.
As I remember, in 2000 H1B visas for universities were not cap-exempt.
Therefore, I may be able to transfer to industry. However, I am not sure.
Does any friend have similar experience? Pleae share your story.

If your H1 was cap subject in 2000, you are supposed to be able to transfer immediately.

If your visa was sponsored by the university, then it was not counted against the quota in 2000. Hence transferring to industry now will come under quota. If u have Masters & above degree there is still some remaining for FY 2006 for which you can try..

If you can apply before the 30th sept, U can apply for FY 2005 quota and ur start date on h1b has to be within 30th of sept and you have to send this application to vermont.

Thanks you all.

I may have to wait for one year since my H1b is subjected to the quota.
One company is considering to give me an offer. In any case, the offer
cannot be made within this month.

There is no way except for waiting since I did not get any degree in the US.
