H1B transfer from India denied for my spouse, other options required to get a H1

Hi,
I'm a H1B visa holder and my wife has a h1b from an MNC in India. We tried to transfer my wife's h1b to a us consultant while she was in India. This transfer was denied by USCIS. She has validity till 30-Jun-08.

My consultant says that she can get a H4 using my h1B and enter into U.S, then she can get a job and apply for H1B using the same quota of her existing H1b(not the new quota of 2008 or later).

Is this correct? Does it have some riders in it like such changes has to be done only within the U.S etc.

Please help as we are struggling to find the right answer.

Please don't spam the forum. Instead, pick one thread and explain what exactly your situation is. How can a company from India sponsor your wife's H1B for example?

If what you referred as "transfer denial" is actually H1 denial, changing status from H4 to H1 will end up in the same result. Unless you know the reason why it was denied, you won't find the way out.
